1. About GarageTome
These Terms of Service govern access to and use of GarageTome.
GarageTome is operated by Emasmas EIRL ("GarageTome", "we", "us", or "our").
These Terms are written in English. Any translation is provided for convenience only and the English version prevails in the event of inconsistency.
2. Description of the Service
GarageTome provides software for fleet management, maintenance tracking, and operational control.
We may update, improve, suspend, or discontinue parts of the service from time to time.
3. Accounts and Acceptable Use
You are responsible for safeguarding your login credentials, all activity under your account, and the accuracy of the information you provide.
You must use the service lawfully and must not attempt unauthorized access, interfere with the platform, or misuse the service.
4. Subscriptions and Billing
Paid plans renew automatically unless canceled before the next billing date.
Prices, plan limits, and features may change from time to time. Any change will apply prospectively and, where required, we will provide notice before it takes effect.
5. Merchant of Record
For purchases processed on garagetome.com or an approved GarageTome checkout domain, Paddle acts as merchant of record and authorized reseller.
Paddle processes checkout, payment collection, applicable transaction taxes, and payment-related records for those transactions.
6. Refunds and Withdrawal Rights
For transactions processed by Paddle, refund eligibility, withdrawal rights, and refund handling are governed by the Paddle Buyer Terms and Paddle Refund Policy.
Where Paddle's policy or applicable law gives you additional or non-waivable rights, the higher level of protection applies.
Nothing in these Terms limits any mandatory consumer rights.
7. Cancellations
You may cancel your subscription at any time to stop future renewals.
Unless otherwise required by applicable law or Paddle's policy, cancellation takes effect at the end of the current billing period and amounts already charged for the current period are not prorated.
8. Availability and Support
We aim to keep the service available and reliable, but uninterrupted or error-free operation is not guaranteed.
Planned or emergency maintenance may affect availability from time to time.
9. Intellectual Property
The GarageTome platform, content, branding, and software remain the property of Emasmas EIRL or its licensors.
Except where expressly permitted, you may not copy, resell, reverse engineer, or exploit the service beyond the rights granted to you.
10. Privacy
Our collection and use of personal data are described in our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by applicable law, GarageTome is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities arising from use of the service.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Chile.
Any disputes arising out of or relating to these Terms or the use of the service are subject to the jurisdiction of the courts of Santiago, Chile, unless applicable consumer law requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time.
The version published on this page is the version currently in force as of its effective date.
